Terms and Conditions for The Picnic Boutique 

It is the responsibility of the Client to read the Terms and Conditions carefully prior to booking.

By making a booking with The Picnic Boutique, the Client agrees to the following Terms and Conditions:

 

  1. Quotation 
     

    1. By submitting a booking order, the Client agrees to the price outlined in the written quotation.
       

    2. All quotes provided to the Client will expire within fourteen (14) days of the issue date. 
       

    3. The Picnic Boutique reserves the right to amend prices in any quotation after fourteen (14) days of issue. 

       

  2. Deposits, Invoices and Payments
     

    1. A deposit of 50% of the invoice is due upon booking to secure the event date.
       

    2. The deposit will be deducted from the Clients invoice and will be subject to the terms and conditions relating to Postponement under section 5 and the terms and conditions of Cancellation under section 6.
       

    3. The remaining 50% of the invoice is due ten (10) days prior to the event date to guarantee the booking.
       

    4. If the Client fails to provide payment ten (10) days prior to the event, The Picnic Boutique reserves the right to cancel the booking and is not liable to refund the 50% deposit paid by the Client.

       

  3. Security Bond
     

    1. Upon booking, the Client agrees to be charged a security bond of $200.00 for up to twenty (20) people, or $300.00 for more than twenty-one (21) people. 
       

    2. The security bond will be refunded after seven (7) days of the event and only at the sole discretion of The Picnic Boutique, if:

      a) all the hire items are accounted for; and
      b) all the hire items are in the same condition prior to the hire. 
       

    3. The Client agrees to cover all costs associated with any loss or damage incurred which is valued above the security bond, within seven (7) days of the event taking place. 

       

  4. Loss and Damages
     

    1. The Client acknowledges that they understand the proper use of all products and items and will use them in line with their proper purpose and agrees that they will be liable for any damage or loss incurred from improper or accidental use.
       

    2. If any product or item is deemed by The Picnic Boutique to not be in the same condition as delivered or set up, the Client agrees to pay for the loss and damage to return the product or item to good working condition or to replace the item or product, if it is beyond repair. If the item or product is in a set which cannot be replaced as a single item or product, the Client will be liable to pay to replace the entire set of items at a similar value, such as but not limited to, a set of cutlery or a set of crockery. 

       

  5. Postponement
     

    1. A Client must request a postponement in writing and obtain written approval from The Picnic Boutique as confirmation.
       

    2. If a client postpones an event more than fourteen (14) days out from their original event date, no fees will be charged provided that a new date has been approved by The Picnic Boutique and the new event date is within twelve (12) months of the original event date.
       

    3. If a Client postpones an event within fourteen (14) days of the original event date, the Client will be subject to the terms and conditions of Cancellations under section 6.
       

    4. If the Client cancels the event after an approved postponement, they are not eligible for any refund and The Picnic Boutique reserves the right to cancel their booking without liability.
       

    5.  All postponement dates are subject to approval of the Picnic Boutique and if the Client cannot find a suitable alternative date, the Client will be subject to the terms and conditions of Cancellations under section 6.

       

  6. Cancellation 
     

    1. To cancel a booking or invoice, the Client must provide written notice to The Picnic Boutique.
       

    2. If twenty-one (21) or more days’ notice from the event date is provided, The Picnic Boutique will refund the 50% deposit paid by the Client.
       

    3. If less than twenty-one (21) days’ notice from the event date is provided, The Picnic Boutique will retain the 50% deposit paid by the Client and The Picnic Boutique will have no further liability to the Client.


 

  1. Changes to Booking
     

    1. To change a booking or invoice, the Client must provide written notice to The Picnic Boutique and obtain approval from The Picnic Boutique.
       

    2. The Client is liable to pay 80% of the original agreed invoice price if the booking is reduced by more than 20% of the original agreed invoice price.
       

    3. If the Client reduces the booking, guest numbers, package inclusions or items within ten (10) days of the event date, the Client must pay for the original agreed invoice price and The Picnic Boutique will not be liable for any refunds.

       

  2. Weather
     

    1. The Picnic Boutique will not offer refunds due to bad weather on the date of the event.
       

    2. It is the Client’s responsibility to have a suitable alternate location in the event of bad weather.
       

    3. The Picnic Boutique will not be held liable for any costs relating to postponement or cancellation of the event due to bad weather.
       

    4. The Picnic Boutique will offer free delivery within 20km of an alternate location in the event of bad weather, however, this must be agreed to and approved by The Picnic Boutique at least 24 hours from the event date, and will be at the Client’s expense.
       

    5. If the Client does not find an alternate suitable location at least 24 hours from the event date or The Picnic Boutique does not approve of the alternate location, The Picnic Boutique will not be liable to offer any refunds and reserves the right to cancel the booking at no further liability to the Client.

       

  3. Force Majeure
     

    1.  The Picnic Boutique will not be held liable if it cannot operate or perform its obligations if such performance is delayed or hindered by circumstances outside of The Picnic Boutique’s control. 
       

    2. The Acts, events or circumstances which give rise to a Force Majeure event includes but is not limited to Acts of God, Government direction or Government regulation.
       

    3. If the Force Majeure event is activated, the Client may postpone the original event date where required to ensure The Picnic Boutique can fulfill the booking, up to twelve (12) months from the original event date.
       

    4. The Picnic Boutique will not be held liable if the original event date is postponed, or any subsequent event dates are postponed directly or indirectly due to a Force Majeure event. 

       

  4. COVID – 19
     

  5.  The Client and or The Picnic Boutique may postpone the original event date where required to ensure The Picnic Boutique can fulfill the booking in line with public health orders and restrictions enforced by the State or Federal Government in relation to COVID-19. In such circumstances, the Client may postpone the event date up to twelve (12) months from the original event date.
     

  6. The Picnic Boutique will not be held liable if the original event date is postponed, or any subsequent event dates are postponed directly or indirectly due to COVID – 19.
     

 

11. Venue and Location

11.1 The Client is responsible for choosing a suitable location or venue and acknowledges that if the event is cancelled due to location or venue requirements, the Client will be liable for the cost of the booking. In such instances, The Picnic Boutique will not offer a refund and will have no further liability to the Client.


11.2 Once the items are delivered, The Picnic Boutique will only relocate the items at its sole discretion and under the following conditions: 
 

a) additional travel fees will be agreed to by the Client and must be paid prior to relocation; and
 

b)  an additional one (1) hour fee will be charged for relocation to any venue or location and must be paid by the Client prior to relocation; and

 

c) an additional one (1) hour fee will be added for relocation to any venue or location which is more than 20km outside the original venue or location and will be charged an additional one (1) hour fee for every 20 km thereafter; and


d) The Picnic Boutique will not be held liable if the hire time must be reduced due to the relocation of the event and no refunds will be offered to the Client; and

 

e) the Client accepts liability for the deterioration of the food due to the relocation of the event and will not hold The Picnic Boutique liable.


11. 3 The Client must obtain the relevant permits and or applications and abide by any State or Local government rules and or venue regulations to ensure the booking can be fulfilled. 

11. 4 The Picnic Boutique does not accept responsibility for the approval or non-approval of permits or applications, and the Client understands that this is their sole responsibility.

11.5 The Client understands that The Picnic Boutique is not liable for any cancellation arising directly or indirectly from the Client’s inability to gain an appropriate permit and or application and or the cancellation of permits and or applications and or failure to abide by State or Local government rules and or venue regulations.
 

 

  1. Hire Time
     

    1. The hire time of the booking is four (4) hours from set up and any additional hours can be added at a rate of $100.00 per hour for groups of up to 20 guests and $150.00 per hour for groups of twenty (20) or more guests. 
       

    2. The Client may extend the booking hire time on the day. If the hire time is extended on the day of the event, the additional hours must be paid for by the Client within seven (7) days of the event taking place. 

       

  2. Delivery / Set Up / Access
     

    1. The Client must ensure delivery, set up and pick up access is suitably arranged and agreed to by The Picnic Boutique at least seven (7) days ahead of the event date.
       

    2. The Picnic Boutique will not move or restyle any products or items once they are set up, unless agreed to by The Picnic Boutique and at an additional fee agreed to by the Client which is payable on the date of the event.
       

    3. The Client is responsible for organising reasonable access to the venue or event location for delivery, set up and pick up. Any locations that provide difficulty to access or will impact the delivery, set up or pick up, must be discussed and approved by The Picnic Boutique at least seven (7) days ahead of the event date.
       

    4. The Client is responsible for any costs related to parking required for delivery, set up and pick up.
       

    5. The Picnic Boutique requires the event location to be no more than 20 meters from the car park and must be sufficient for a long van or trailer.
       

    6. Delivery and pick up hours outside of 8am and 5pm will incur an additional fee of $50.00.
       

    7. The Client takes responsibility for inspecting all products and items upon delivery so as to ensure they are in good working order and fit for purpose, and the Client must bring any breakages, damages or discrepancies to the attention of The Picnic Boutique within thirty (30) minutes of set up. This must be done via email with an attached image to substantiate the breakage, damage or discrepancy.

 

 


14. Food

14.1 The Picnic Boutique reserves the right to substitute food items if they are not available. All substitutes will be of similar quality or value and at the sole discretion of The Picnic Boutique. 


14.2 The Client is responsible for informing The Picnic Boutique of any dietary requirements upon booking.
 

14. 3 The Picnic Boutique is not liable for any loss, damage or injuries incurred directly or indirectly from the food.

14.4 The food provided by The Picnic Boutique is not suitable for people with allergies and cross-contamination cannot be guaranteed, therefore it is the Client’s responsibility to:

a) ensure that the food ordered is suitable for the guests; and

  
b) inform their guests that The Picnic Boutique cannot guarantee an allergy free environment.

14.5 All food should be consumed within two (2) hours of delivery. The Picnic Boutique cannot be liable for the freshness of the food thereafter. After two (2) hours of delivery, the Client should refrigerate any remaining food.
 

 

15. Fines 

In the event that The Picnic Boutique is issued with a fine due to the instructions of the Client, or at the designated carpark of the Clients’ chosen location or venue, or due to the requirements of delivery, set up or pick up at the Clients’ chosen location or venue, the fine will be payable by the Client within seven (7) days of the event taking place.

 


16. Rights to use Images

The Picnic Boutique reserves the right to use images taken by The Picnic Boutique, its employees or representatives and any images made publicly available by the Client, their guests or the public on Facebook and Instagram, for marketing purposes.
 

 

17. Exclusion of Liability

17.1 The Picnic Boutique will not to be held liable for any damage, personal injury or loss that may occur before, during or after the event hire period or as a result of the use or misuse of any products, items or food. 

17.2 The Client understands and agrees to indemnify The Picnic Boutique against any claims, proceedings and actions for damages, costs, losses, and expenses of any nature which The Picnic Boutique may incur directly or indirectly in connection with the booking.
